Rental Agreement Terms & ConditionsABSTRACT:This Rent to Own Program Agreement, hereinafter Agreement, when executed, entitles Customer to rent one AquaLiv HOME water enhancement system, hereinafter System. The Customer agrees AquaLiv Inc. maintains all rights of ownership of System until the terms of this Agreement are totally and completely fulfilled.
TERMS OF RENTAL AGREEMENT:Payments & Billing:Customer agrees to pay $999 as a down payment to execute this agreement. The date of this down payment is the Purchase Date.
Customer agrees to make twenty (20) monthly payments of $99 thereafter.
Payments are due on the day of the Purchase Date each subsequent calendar month. Should the purchase date fall outside of the last day of the month (e.g. 29th, 30th, or 31st in February), the payment will be due on the last day of the month.
Customer understands that if scheduled payments are not made, AquaLiv Inc. may report the delinquency to Experian, TransUnion, and Equifax. Customer further understands that such a delinquency may have serious consequences, such as a reduction in their credit score, and that she/he understands that this contract is as binding as any loan.
Customer grants AquaLiv Inc. the permission to assess a $20 late fee for each 10-day period the account remains delinquent.
Customer agrees that until she/he has paid the $999 + twenty-$99 payments, that the System will remain the sole property of AquaLiv Inc.
AquaLiv Inc. agrees to relinquish all claims to System when it receives a total of $2979, at the end of the 20-month period or anytime in between.
Customer agrees that only the down payment and payments contribute towards the $2979 amount- late fees do not apply.
Customer agrees that should a billing dispute arise, that proper jurisdiction shall lie in the County of Thurston, State of Washington.
There are no prepayment penalties.
Returns & Refunds:Customer may return the System for a full refund of all monies paid to AquaLiv Inc., within 90 calendar days of the Purchase Date, per our Unconditional Money Back Guarantee.
Customer agrees that if AquaLiv Inc. has not taken delivery of System before 90-day period expires, that Customer forfeits all rights to any refund whatsoever.
If Customer wishes to return System after 90-day period, and Customer is current with her/his monthly payments, AquaLiv Inc. will cease further billing and Customer will owe nothing further to AquaLiv Inc.
If Customer wishes to return System after 90-day period, and Customer is delinquent with her/his monthly payments, AquaLiv Inc. will continue billing until all monies due before System was returned plus late fees are paid. Late fees will continue to be assessed until account is satisfied in full.
Customer agrees that she/he is responsible for packing the System and all return shipping-costs. Customer acknowledges that AquaLiv Inc. does not offer refunds on damaged Systems or Systems that have been tampered with. If internal tamper seals are broken on Modules Two and/or Four, indicating System was opened, System will not be refunded. Shipping insurance is strongly suggested.
Rewards & Credits:AquaLiv Inc. agrees to apply all rewards Customer earns through any Referral Program to Customer’s Account, just as if those rewards were cash payments paid by Customer.
Customer acknowledges that the terms of any Referral Program may change over time and that rewards, if any, will be credited according to the current Referral Program terms at the time the referral was made.
